CXMT sues Pentagon over ‘Chinese military company’ designation
CXMT, the world’s fourth-largest DRAM maker, is seeking removal from the Pentagon’s Section 1260H list of Chinese companies with military ties to Beijing. It was first added to the list in January 2025, and kept on the list after a review in June.
CXMT, China’s leading memory chipmaker, has sued the Pentagon over being placed on a list of companies the US says are helping Beijing’s military, according to a report by Reuters. Defense Secretary Pete Hegseth is named as a defendant in the lawsuit.
“CXMT is not affiliated with the Chinese military,” the company said in the federal lawsuit. “CXMT designs, produces, and sells its DRAM chips for civilian and commercial use, not for military use.”
The US Defense Department told Reuters that the Department “does not comment on pending or ongoing litigation.”

The blacklist means the Pentagon cannot directly contract with the company, and other restrictions could be added from June 2027. Customers, banks and suppliers may also be discouraged from doing business with listed companies.
Other Chinese tech giants have also been placed on the list. In June, Alibaba sued the US government over being placed on the list. Xiaomi got itself removed in 2021 by filing a suit in a US court.
